Excellent weekend in Isla Mujeres celebrating Mexican Independence LINK

The Port Authority filed a complaint with PGR for invasion of the port area (by boats of local fishermen) LINK
On August 24, the Port Authority of Quintana Roo (APIQRoo) filed a complaint to the Office of the Attorney General of the Republic (PGR) for irregular occupation in a space within the port, concerning an area occupied by at least 60 vessels. Personnel with APIQRoo confirmed the story and said that although the boat owners have been approached, they have shown no intention to withdraw voluntarily.
"We know that they have tried to regularize the federal zone, which they have not been able to do, and they won't be allowed, because it is a port and APIQRoo is responsible for that space," said APIQRoo staff.
The Port Authority has ruled out the idea of anyone being able to have a concession in this zone because it is considered as a reserved area of the port. They say it has been misused, since work is being done with fiberglass, as well as mechanical work, and there are even irregular constructions (palapas and sheds). He said that there have been several thefts in this area, coupled with the trash that always exists.
(I think this is along the area behind the whale shark statue.)

CONANP: Whale shark licensees will be subject to new rules LINK
The Regional Director of the Mexican Caribbean and Yucatan Peninsula of the National Commission of Natural Protected Areas (CONANP), Ricardo Gómez Lozano, said that the renewal of permits for next year will be subject to the results of the inspections that were done this year. He described the results of this season as a "model" season. It is noted that this season is nearly over.
He said, "250 authorizations were issued, some of which are under review, in relation to port authority procedures, and we will also consider the results of the inspections, including both those done by us and those done by the Federal Environmental Protection Agency."
He said that during the current season of observing and swimming with the Whale Sharks, several actions of supervision and surveillance were conducted, including by the Department of the Navy. He did not specify the number of  'levantadas' (citations) that were issued this season, but he stressed that these will be taken into account regarding the renewal of permits next year.
He said that citations were issued against vessels with and without permits who carried out activities in an irregular manner, and therefore, sanctions will surely be given. The regional director of CONANP, said that after meetings with permit holders, it has been decided to continue with granting only 250 permits and no more.
The official lamented that there were some people who decided to ignore the law and went out, who not only jeopardized their permits, but also their business. He said, "We were very clear from the beginning that those who risked going out without having a permit in hand and were sanctioned, will not be able to obtain their permit for next year."
He said that only the responsible permit holders and those that worked hand in hand with the authorities, protecting the species, will be the ones who will definitely continue.
He said that one of the proposals that was made with the permit holders was that there should be no more than 120 boats per day, which was fulfilled through the good practices that they proposed. "It is necessary to recognize and applaud that they themselves seek to protect the species by taking measures like that of compulsory rest," he said.
Regarding the complaint that some permit holders have more than 10 authorizations and others with three were having problems, the official said that since this year he has been talking to several of them, seeking to reduce the number of their permits. He said, "We do not want to play favorites, but with those that still have several permits, if they do not comply, they are at risk of losing them."

Asking that fraudulent jewelry stores be punished
Exigen castigo a joyerías defraudadoras.. [+] Ver mas
See yesterday's translations regarding complaints about jewelry stores that allegedly sold false stones and metals or overcharged on credit cards, according to the TripAdvisor website. The entrepreneurs want intervention by PROFECO, The Federal Consumer Protection agency. The current manager of the Isla Mujeres PROFECO module said they have had no official complaints. Representatives with CANACO and CANIRAC, chambers of commerce say they are interested in contacting the Mayor to expose these problems and others in the business sector.
In fact, when Mayor Carrillo Soberanis, was the PROFECO representative on the island in 2008, several fines and sanctions were issued against merchants who abused visitors. He is no stranger to the problem, therefore, he organized the return of PROFECO to the island to address these types of problems.
The PROFECO module does not currently have a permanent official in the island who gives daily attention to the necessity of supervising the commercial sector. Business owners want action taken because it bad business practices and deception reflect badly on the reputation of everyone in the business community. They say the vast majority of these accused merchants are outsiders and the resident entrepreneurs are concerned about bad practices being done by these competitors who come from outside the community. One concerned CONACO member said, "They have come to discredit the commercial sector of Isla Mujeres, therefore we are asking for intervention by the municipal and federal authorities.

Whale shark tours have little transparency
Poca transparencia para tours del pez dominó. [+] Ver mas
The whale shark season will conclude on Sunday, Sept. 17. It is noted that there was controversy concerning the permits from SEMARNAT (Ministry of Environment and Natural Resources). There is a sense of a lack of agreement between the two agencies of this federal Ministry, the National Commission of Natural Protected Areas (CONANP) and the General Directorate of Wildlife (DGVS), and a lack of clarity about their protocols for approval and disapproval for permits, in time and form, according to the licensees. Finally, in July, 230 permits were issued, with complaints about the monopolization and inclusion of large companies such as Ultramar, who had a half dozen boats for this service. This doesn't adhere to the spirit of the law and its social benefits,  which is that the permits should go to the seamen of the cooperatives and the fishermen of the nearby municipalities of Lzaro Cardenas and Isla Mujeres.
There is no report about the level of protection achieved by PROFEPA (Federal Attorney General's Office for Environmental Protection). There are complaints on social networks about physical damage being done to more whale sharks, who suffer cuts from outboard propellers.

Lack of buoys
The federal government hasn't established new routes for the passage of freighters and cruise ships which travel through the Yucatan Channel and pass thru the feeding zones of these giants of the sea. The Harbor Master said this is a national issue, to be resolved with foreign relations, for an agreement between the countries to protect the species. It is unknown whether any legal processes are underway by SEMARNAT or the SCT (Secretary of Communication and Transport).
It is also unknown how many international signaling buoys would be needed to protect the more than 400 whale sharks that arrive each season to feed, but two or three buoys could indicate the places where the freighters and cruise ships should pass.
